lane. I was going around 20/30k's and tried to break in time as I realised he wasn't going to stay in his middle lane, following the cars in front of him, as I expected. This happened in a 3 lane street, my far left lane where I was driving, and 2 lanes where traffic was turning from the right. He had built up in traffic and was obviously in the middle lane, when my lights turned green I proceeded to go forward, then moments later it seems he changes his mind and continued into my lane - causing us to hit fronts. Now, my front bonnet is largely dented - cannot open door fully! HIS TRUCK HAS NO DAMAGE WHAT SO EVER. I got all the details from him, was in total shock as this was my first accident ever, i have no witnesses or police report. I reported to Insurance Comp, and now it seems he has LIED that I suddenly changed lanes into his and hit him. IS THERE ANY WAY TO PROVE MY INNOCENCE, BY THE OBVIOUS POINT OF IMPACT? Well if you did not file a police report.That was not very smart because now it is your word against his. You can try to have someone look at both vehicles and determine who hit who. You don't say whether he was signalling, what sort of vehicle he was driving or how long the other vehicle was.

As a truck-driver, I can tell you that YOU, as a driver, must always be aware that a large vehicle may need TWO lanes to make a turn, and YOU must take responsibility for permitting the driver of the truck to do so.
That said, he was being fairly stupid if he didn't see you UNLESS you had positioned yourself close to his vehicle, in which case you MAY have been in a mirror blind-spot.

It can be a real problem when driving a truck, but I always make a point of never taking my eyes off the lane next to me, and into which I have to turn to complete a manouvere without demolishing all the road signs and squashing half a dozen pedestrians.
If he failed to signal, HE was at fault. If he WAS signalling, then YOU may be to blame.

You should've filed a police report as there's no way to prove what happened. The general rule of thumb is that whoever is at the rear is at fault because the car in the back can see the car in front. I'm guessing that's you ... should've stayed away and kept a one-car distance from the car in front of you. But there are loopholes because if he hit the middle to the back portion of your car, then he should've already seen your car and waited for you to pass before going to your lane. Goodluck.

it does not sound like you are in america but here, chances are it will be a 50%-50% split as far as who's fault it was. with no witnesses its basically his word against yours and unless its obvious what happened by the damage, it will be fifty/fifty and you will end up paying half of your deductable to get your car fixed. unless there is some type of evidence other than the words coming out of your mouth to whoever decides the case, that will be what they decide in all likelyhood.More Questions & Answers ...
