If my son is driving the car and his partner is in the passenger's seat and therefore responsible for watching him drive. Is she allowed by law to use a mobile 'phone? Her attention will not be on my son's driving.

For a start - you have to have had at least two years driving experience before being able to teach someone to drive! Are they insured? How much 'teaching' is she doing if she is on the phone anyway?Or is she just driving around hoping he doesn't actually crash into anything!
she must have held a full licence for 3 years and be over 21,if the tutor commits or abets in a driving offence she is liable for prosecution, so i would say she is not the best person for the job!
