Like your previous answers, it depends on the town, city, or county that sets the zoning laws. I am not sure where you are from, but in Massachusetts these are considered to be "Public Ways" unless it is otherwise posted, (i.e. Private way). A public way is defined as a way that is used by the public as invitees or licensees. It gives them the right to use it lawfully.
