yes it is illegal.In the state I live in it is legal to pass on the right as long as you stay in a legal lane. I wish I never needed to pass on the right but I see people driving 5 mph below the speed limit in the left lane too often.

It's probably illegal in some states, but there's not really any "safety" concern if the other car is going too slow for the left lane. If there are two lanes then yes you can pass on either side.If it is a single lane and it is wide enough you are allowed to pass on the right BUT you have to be able to do it within 200 feet and not exceeding the speed limit. If it takes you longer than 200 feet then it is considered illegal.
If there is no actual lane on the right, then it is illegal to pass on the right. It sounds dumb, but I got a warning from a State Patrol officer for doing that just this past summer. I have a friend that is a county deputy, and he said he would never pull someone over for doing that, but it is illegal. Now if there's a lane, like on a highway, and some idiot is in the passing lane driving slow, then its legal because there is a lane there.
