However, other variables are considered, such as how far you traveled prior to the rear end, how much time between the cut off & the rear end lapsed prior to the impact, how much of their vehicle was in your lane when the impact happened, the point of impact to both the vehicles which may very well rest liability with you or whoever the rear ender is.sadly, you hit them, therefore your fault, in the eyes of the law anyway.

Those are scammers.they want to get rid of their cars for various reasons.Technically is your fault,but if you are lucky enough to find a witness that can testify for you in court(i doubt you may find one in the expressway,when everyone is in a rush to go home)may be you wont be screwed.My solution for this is:Put a lot of cameras in every portion of all highways.
Unfortunately, yes, they will say it is your fault. This is a popular insurance scam. They cut you off, you hit them, they fake injuries to sue your insurance company, and we all pay higher premiums. It's not fair, I know.
The burden of proof is yours, so the odds of winning this one are slim. Just get off the go pedal and hit the brakes as needed, give 'em a good cussing, and get on with your trip.
