A speed-trap camera tagged me at 51mph and said the posted spped limit is 40mph. All the signs say 45mph.!!?

I was doing 51 in a a zone the signs say 45. The ticked I got in the mail said I was in a 40 zone. That's crap. I can appeal it, anyone have experience with this, and if so how should I contest it and what should I say?

Yes, fight it. There should be a section on the ticket to appeal. Take pictures and go to court, if nothing else you should at least be able to get it reduced.

I like what Hawk said. Document everything. Also, depending on your driving style, you may consider taking that stupid safe driving course and then the ticket doesn't count. Of course, that's not an option if you rack up many tickets. I almost rarely get a ticket, less than 1 every 4-5 years, so that's a better option than trying to fight the ticket and potentially losing, then still paying for ticket and higher insurance rates. But if you're a habitual speeder, you have nothing to lose by fighting.

you could contest it but you would only be paying less cuz you still went over the limit but you could go back to where ever you got busted and take a pic of the exact place and the closes speed limit sign and take that with you

you were still speeding. If you go to court, don't use that as a defense. Why not get a lawyer and challenge the camera? How can a camera prove beyond reasonable doubt YOU were driving the car? Maybe you loaned it to some one else! I don't understand how they are getting away with ticketing people with these stupid cameras. It needs to stop.

So far you have some great answers here. First thing is fight the ticket by putting not guilty. But then it's up to you to go take pictures of EVERY speed limit sign within a mile and you might be wrong about the 45mph.

Your biggest problem is that you cannot goto court and say that you were doing 51 because speeding is speeding and you would be admitting guilt. Your best hope is to say that you were going 45mph, bring in the evidence of the speed limits and roll the dice.

Go ahead and fight it. You'll still get dinged for 51 in a 45 though. I'd get an attorney and see if he or she can plead it down to a no-points violation such as defective equipment. That will cost less in the long run when you take the possible insurance surcharges for the next 3 years into consideration.

traffic camera's mail the camera to the registered owner of the car. it doesnt discern who was actually driving it at the time of the 'violation'.
i'd get a lawyer and try to fight it on the grounds listed. ya might just wind up gettin an injunction against the camera, and get it shut down. they did it in girard, case is still appealing from last reports, but the camera has been shut down as being unconstitutional and in violation of state law.
