In June I was involved in a accident. A bicylist was riding on the sidewalk and the wrong way when I was pulling out of a parking lot and hit her front tire. She was cited (I was not) and on the police report it was her fault. I called my insurance and gave them the information and then I get a letter in the mail from the insurance saying I am 50% at fault. How is that so? I have not heard anything more from the insurance company but she did hire an attorney! For what? It was her fault!! What should I do? I am thinking of writing to the Insurance Commissioner.

If the report says she was at fault then there is nothing she can do. I would find a lawyer that offers a free consoultation and tell him what happened, show the report and anything from both insurance companies. Then he can advise.Did someone try to steal my car?
I don't see how they could do that if they have in their possession the police report that incidated you were NOT at fault. You need a satisfactory answer as to why this is the case. Insurance companies don't willingly accept ANY responsibility when there's a police report to the contrary. Are you sure the police report is in your favor?to determine how fast you was going in a car wreck by how far you slide?
Well, I do know that bicyclists have to follow all the traffic laws as everyone else, so it sounds like they were at fault. As far as your being responsible for 50% with your insurance company, well that sounds more like a policy of your insurance company. I know there is a type of insurance in some states called NO-FAULT insurance that automatically pays out for accidents, but only a percentage. it may be 50/50 because you were crossing a sidewalk ,you are responsible for looking both ways before crossing as it could have been a pedestrian as well.More Questions & Answers ...
