How many of you forget to use your turn signal?
Any questions like this should show which state you are from. State laws vary from state to state which affects cases like this. In Virginia it is against the law to change directions after giving signal. It is also against the law to pass on the right unless you can do so without leaving the travel portion of the highway. The insurance company if you have a good one should be able to give you guidance as to your liability or the other driver's.You can always sue another person. Winning depends on you convincing the Judge or Jury that you have been wronged by the other person.
