I was injured on duty, and off for 7 weeks, can I claim compensation?

I am a coach driver and trapped a nerve in my neck because I was sent out to do a duty in a coach that they knew was defective, but I was unaware of it. Once I informed them of the injury they called me back to the depot and took me off to hospital. I was then booked off basically one week at a time, I managed to get the company to pay for 8 physio sessions, but in the mean time I have been unable to do much due to the nature of the injury. I am still taking painkillers and anti depressants ( to help me sleep), and am fairly concerned about how long it will take me to get the full use of my left arm back. I am aslo concerned whether I will be covered if during the course of duty or not I hurt it again and am back at square 1. I return to duty on 8th Jan. 2007, but will be restricted to driving city busses where I will not need to help with luggage, but might need to assist the disabled with setting down a manual ramp and pushing the wheelchair into and out of the bus

I would check with your local Job Center or State's department of workforce development. Since you were injured while on the job your employer should be paying for your doctor's visits as well as any medication, etc. To me, it sounds like you qualify for short-term disability, but each state is different. If you have had no previous back problems, then your employer's insurance company has no grounds to deny coverage to you for any treatment because of a pre-existing condition.

These expenses should include lost wages, medical visits, medical expenses, and perscription drugs. Talk to your human resources people and see what you have to do to get fully compensated first. Do they have anything Like "workers compensation" where you are? The company has already admitted thier fault by paying for the Dr. visits and admitting that the coach was deffective. You are stateing a case. You have said, a thing they knew was defective, but I was unaware.Informed them of an Injury that occured while working on a defective mechanism. Now you are takeing multiple medications as a result of the injury. And then you fear that if the injury sustained becomes aggrivated or worsens what is your legal standing.
Sounds like you need to speak with an attorney to actually see if you have a case or should start looking for a different job.

The biggest problem I can see here, is how you can connect a trapped nerve to driving a defective bus.

Was it caused in an accident? If not then i dont see how its the companies responsibility. A trapped nerve can be caused by several different factors.

You are of course entitled to stat sick pay but I doubt any lawyer worth his salt would help handle a claim against the company for compensation.
