My husband was recently in a wreck he and the van had the right of way. the only thing is since neither one had a stop sighn, but the van was turning the van should have yielded, right? my hubby got sited with being at fault. the roads were slick the speed limit was 25, he was driving 5-10 mph. can this be faught and won?

Yes, you had the right of way. By any chance did the van have their blinker on? If they didn't, they not only failed to yield, but they failed to make a turn without using a proper signal. When you go to court, on the assigned date, argue about the ticket. Be polite and courteous when you do this. Most of the time the judge will allow you to have a reduced fine or throw it out all together. Also, just because the police officer wrote you the ticket citing you, doesn't mean that is the end of the discussion. LIke I said, tell your story again in court and you could be surprised at what happens. Also, where did you strike the van? On the side? On the front side? On the back side? That might be the reason the officer wrote you the ticket, based on where you hit the van. If you are really lucky, the officer will not appear for court, and you could have your ticket thrown out altogether. He should definitely fight this. Do not accept fault! Argue with the claims adjuster until he just settles it as a 50% fault loss which should be the case. If the loss is found to be 50/50 fault, the accident will not count against your husband as far as insurance rating purposes go.
