My dad going throught an intersection (yellow light as he told me) and the other car made a left turn, he hit that car on the rear passenger side. After that he stopped and step out of the car, he saw the other driver waving in the air so my Dad thought the other driver tell him to go (my Dad couldn't speak good English and he was scared so he fled away). My Dad reported to the insurance company after that, and the next day we got a phone call from the police that the other driver reported my Dad passed the red light and Hit & Run (the other driver has a wittness). We just got the police report with Hit and Run felony (Code 20002) and a court apointment. Could anyone tell me what is the charge for my Dad and do we need to hire an attorney or contact the other driver to settle down the lawsuit? Our insurance company will pay for the damage, I just don't want anything happen to my dad.

Were there any witnesses? Were you in the car? Unfortunately, people sometimes want the insurance to pay for their "injuries" when there were none.Your Dad should not have left the scene of the accident.

ask your insurance company but if your father was going strait and the other guy turned in front of him then it seems that the other guy made an unsafe turn because when turning left you must yeild to on comming traffic which sounds like thats what happened

It depends on the jurisdiction but Felony Hit and Run is the charge. It is a fairly serious charge which will lead to loss of license and possible imprisonment although the fact that it was not a fatal accident will reduce the seriousness. I would speak to a lawyer, preferably one with experience of motor laws in your jurisdiction.

@ hit and run is still a hit and run whether anyone is hurt or not. It is still a felony. I would get an attorny, esp if your father can't speak english well. Make sure you have an interpreter @ court as well. Make sure he tells them that he thought they were waving him on. He might be able to make a settlement.

Oh yah, your dad needs an attorney that handles this kind of situation because a hit and run is a felony that can end up in prison. If your dad is convicted, your insurance doesn't have to pay anything and your dad will be stuck with the bill. Meaning the other person will sue your dad not the insurance company.
