I don't know about austrailia, but in the US you cannot have an open bottle of alcohol ANYWHERE in the car. You can transport alcohol UNOPENED in the BACK SEAT out of the reach of the driver, but you absolutely cannot have ANY form of open bottled alcohol ANYWHERE in the car. Not even in the back seat, not even the passanger.

No idea about Australia but it seems so in the states as from what I am reading. In South Africa however its not illegal for the passenger to be on their cell phone or driving with open bottles of alcohol. It is however the drivers responsibility to make sure that his passenger next to him is wearing his seat belt as the driver will get fined for that.
