Happy Thanksgiving, Unfortunately last night me and my friend got into a car accident with each other after dark last night. We were on a side road at night after dark. I was stopped in the middle of the street and my friend was parked at the curb in front . My friend suddenly tried to make a U-Turn just as I started to go so I smashed into his quater panel on the drivers side as he was sideways across the street. There is extensive damage to his 1999 Toyota Solara and no Damage to My 2002 Mercury Grand Marquis. The question is who is at fault him making the u-turn/ 3 point turn across the street or me who drove into the side of him while going straight ahead. Your help is greatly appreicated!

I would say him I think its illegal to just turn around in the middle of the road, you have to pull off and wait for traffic to pass you can't just do a u turn whenever you feel like it.should you pass on the right when driving?

making u turns is illegal, so pretty much seems to fall on his shoulders, I cant see how it would go any different in court. you are responsible for the person in front of you, thats true, but if the person in front of you does something illegal and dangerous that causes an accident, they should assume responsibilityEeee not sure if I want to touch this one.....you should not have stopped in the middle of the street, however he should have not turned into you....then you said you ran into him......

He should have watched as he was making the u-turn....But if you were waiting for him and he went to turn around and then you moved forward and hit his car........maybe you waited and then decided to go ahead and then he moved.....blame goes on both for not being more careful....You say you guys are friends so it would be nice if you volunteered to pay half...and get it in writing that he agrees and that's the end of it just in case...........I take it you guys did NOT call police and make a report?

Here's a question for you - what kind of "side road" were you travelling upon? I presume it was a residential street - in which case, it is incumbent upon the driver making a three-point turn to ensure that the roadway is clear of hazards (especially other vehicles) prior to executing the turn. Through traffic always has right-of-way when making a left, three-point, or U-turn, unless otherwise noted by the presence of a protected left-turn phase traffic signal or other regulatory signage. This is especially true if, as you state, your friend was parked curbside prior to making the three-point turn. Did he signal out from his parked location? If not, he executed an unsafe manuever in pulling away from the curbside; the three-point turn is also an unsafe manuever at this point, as you were in the travel lane and, as such, retained right-of-way.Why do drivers wait to turen on their car blinker after they are in the turning bay?
