?? how many of you run more E.M.S. calls then Fire calls?
I wouldnt exactly say it was your mothers fault, unless she wasn't looking where she was going and she happened to back into the person behind her. The person who was backing down the aisle is a moron, he/she should have just kept driving and either found another parking place, or drove around in a circle to go back to the one they were initially going for. I thik your mother is. The car in the aisle has the right of way, she was entering the aisle, so she has to yield to cars in the aisle. What is the best all-weather vehicle under $6000?
I think it's the other person's fault because the other person was "backing down the aisle." When was this legal to drive backwards? It wouldn't be on a normal road, so I assume a parking lot may follow similar rules...... you should call a lawyer, they won't charge you to talk over the phone. When you stop for a school bus that has its lights flashing and stop sign up...?
THE OTHER PERSON WS AT FAULT FOR NOT LOOKING WHERE THEY WERE GOING AND YOU'RE MOTHER HAD ALREADY STATED BACKING OUT OF HER SPACE.more than likely neither one will be cited for being in the wrong as it happened in a private parking lot and each insurance company will have to pay for their client's damage.

Sometimes I heard there is a no fault clause in parking lots. But it seems if from what I got from your question was your mom was backing up first. Then someone started to back up, and hit her. She wouldn't be at fault. She was first. When you are on the 405 highway and you brake in a Civic from 45-50 MPH and there is no screech are?
I think it's both drivers fault with the majority of fault being with the driver going backwards down the aisle. If the other driver was going forward, he/she would have seen your mom backing out. Part of it depends on how fast your mom backed out. If she was slow and cautious, then 95% of the cause is the other drivers.More Questions & Answers ...
