When driving in California, will you get a ticket for a passenger not wearing a seatbelt, or will the passenger be ticketed? If you were specifically stopped because a passenger was not wearing a seatbelt, it seems that that driver will be ticketed. On the other hand, if the driver is ticketed for something else (e.g. speeding) and if a passenger was not wearing a seatbelt, the passenger will be ticketed.

In most states the passenger will be ticketed as long as they are not a minor but I am not sure how the law is in Cali. No offense but they have some assenine laws there but then again so do other states. Try the DMV website they could tell ya or ask a law enforcement officer they are your best bet.Yep.
